Academic Peak Tutoring – Tutor Terms & Conditions

These Terms & Conditions (“Terms”) apply to all freelance tutors (“Tutors”) engaged through Academic Peak Tutoring (“we,” “us,” or “our”). By accepting tutoring work via Academic Peak Tutoring, you agree to the following:

 

1. Independent Contractor Status

  • Tutors are engaged on a freelance/contractor basis and are not employees of Academic Peak Tutoring.
     

  • Tutors are responsible for their own taxation, superannuation, and insurance obligations.

 

  • By agreeing to this contract, tutors are implying that they have their own ABN or will get one very soon.
     

 

2. Working With Children Check (WWCC)

  • Tutors must hold a valid Working With Children Check (WWCC) (or equivalent clearance) at all times while engaged with Academic Peak Tutoring, unless they have a reason why they do not need one.
     

  • Evidence of a valid WWCC must be provided upon request.

  • By agreeing to be a freelance tutor through our agency, you acknowledge this means you have a valid WWCC.

 

3. Lesson Conduct and Professional Standards

  • Tutors must behave with professionalism and respect towards students, parents/guardians, and their homes.
     

  • Lessons must be delivered in a safe, supportive, and appropriate learning environment, whether online or in person.
     

  • Tutors must not engage in any behaviour that could be considered inappropriate, unsafe, or unprofessional.
     

 

4. Lesson Commitment

  • By agreeing to tutor a student, the Tutor commits to providing lessons reliably and to the best of their ability.
     

  • Tutors should give reasonable notice if they are unable to attend a scheduled lesson.
     

 

5. Lesson Reporting & Payment

  • Tutors must complete and submit a Tutoring Statement directly after each lesson on the same day, documenting the number of hours that lesson took place for. Invoices issued by Academic Peak Tutoring to customers are based on these submitted hours, so tutors must not report any untrue information.

 

  • Each time clients pay us, we will let tutors know, who are in turn expected to invoice us for the corresponding amount. These must include the tutors’ ABN.
     

  • Note, we are not required to pay tutors in the instance where we have not received payment from our customers. We will do our best to receive payment from customers in the event that their payment is not timely and will pay tutors accordingly if we eventually receive their payment.
     

  • Failure to submit hours on time may result in delayed or no payment.

  • Our clients are eligible for a free trial lesson. If tutors are conducting a free trial lesson, they understand that they will not receive payment for this lesson unless the client opts to continue with the tutoring service.

  • The commission for each transaction that our invoicing platform charges will reduce the amount tutors are paid by a percentage. We are not accountable for this decrease in the value tutors are paid.

 

6. Non-Solicitation of Clients

  • Tutors are strictly prohibited from offering, conducting, or arranging tutoring services outside of Academic Peak Tutoring with any clients gained by Academic Peak Tutoring, or any individual that is related to that client, ever.
     

  • Any breach of this condition will result in a fine with a maximum value of $400.
     

 

7. Confidentiality & Privacy

  • Tutors must keep all student, parent, and Academic Peak Tutoring information confidential.
     

  • Student academic information may only be used for tutoring purposes and must not be disclosed to third parties.
     

 

8. Technology & Online Lessons

  • Tutors conducting online lessons are responsible for having a stable internet connection, working camera and microphone, and an appropriate online teaching environment.
     

  • Academic Peak Tutoring is not responsible for technical issues on the Tutor’s end.
     

 

9. Termination of Engagement

  • Academic Peak Tutoring reserves the right to terminate a Tutor’s engagement if these Terms are breached, or if a Tutor’s conduct is deemed unprofessional or unsafe.
     

  • Tutors may also end their engagement with Academic Peak Tutoring with reasonable written notice, provided all outstanding reporting obligations are met.
     

 

10. Limitation of Liability

  • Tutors accept responsibility for their conduct during lessons and agree that Academic Peak Tutoring is not liable for any claims arising from the Tutor’s actions.
     

 

By tutoring with Academic Peak Tutoring, you confirm your agreement to these Terms & Conditions.
